Check the box on line 6 and write in your name if YOU are representing BOTH the Buyer and the Seller
Check the box on line 7 and write in your name on one line and the other agent’s name on the second line, if you are representing either the buyer/tenant or the seller/landlord and another agent from the same broker is representing the other party.
The Broker now represents BOTH parties and neither the Broker nor the agent may represent the interests of one party to the exclusion or detriment of the other party. Specifically:
A). Without written authorization the licensee may not disclose the seller is willing to accept a price or terms other than stated in the listing—or that the buyer will accept a price or terms other than offered.
B). Dual agency has inherent conflicts of loyalty, obedience disclosure and confidentiality. Disclosure of confidential information may only be made with written authorization. Licensee is not relieved of their legally required burden of disclosure.
C). No obligation to disclose natural death, suicide, homicide or any crime classified as a felony, owned or occupied by a person exposed to HIV or diagnosed with AIDS or any other disease not know to be transmitted through common occupancy. Or located in the vicinity of a sex offender
D). Licensees shall exercise reasonable skill and care
E). Licensees are obligated to deal honesty with all parties
F). Seller and Buyer are obligated to protect their own interests
Compensation shall be paid according to separate agreement(s).
All previous agreements between the Broker and a principal in the transaction remain intact however, should there be a conflict between the Consent and the previous document—the Consent supersedes.
- The Consent terminates with the contract.
- Standard hold harmless language
- Acknowledgement and signature of all principals in the transaction.
